Terms of Use (CGU)

This English translation is provided for convenience. The French version remains the legally binding version. These documents are governed by French law.
Article 1 – Purpose of the service
1.1. GT7 EngiRace is a SaaS web application providing tuning recommendations (“setups”) for the Gran Turismo 7 (GT7) game, together with community preset sharing tools.
1.2. The service includes:
a free rules‑only mode without account, providing recommendations based on predefined rules; an AI‑based mode generating setups using credits (purchased or gifted) or through BYOK (Bring Your Own Key), where the user’s own API key (Google Gemini, OpenAI, Anthropic, etc.) is used.
1.3. These Terms of Use apply to all users, whether visitors, free users or paying users.
Article 2 – Service publisher
2.1. GT7 EngiRace is published by:

2.2. The publisher operates in the field of web development, SEO and SaaS services, and is responsible for the content and operation of the service.
Article 3 – No affiliation
3.1. GT7 EngiRace is not affiliated with:
Sony Interactive Entertainment; Polyphony Digital; the Gran Turismo franchise.
3.2. Third‑party trademarks and product names are used for descriptive purposes only. All rights remain with their respective owners.
Article 4 – Access conditions
4.1. Access to the service requires an Internet connection and a compatible device (computer, smartphone, tablet). Related costs are borne by the user.
4.2. The free rules‑only mode is available without account. Some features (history, community presets, BYOK, credits) require account creation.
4.3. Account creation is handled via Clerk (authentication via email, Google account, etc.). Users must provide accurate information and keep their login credentials confidential.
4.4. Upon registration, users may receive 5 free credits (offer subject to change). These credits are intended for testing AI features and cannot be converted into money.
Article 5 – Personal, non‑commercial use
5.1. GT7 EngiRace is intended for personal, non‑commercial use by individual players.
5.2. The following are strictly prohibited:
using the service to provide paid consulting services or to sell setups to third parties; reselling, renting, transferring or making setups or service features available to third parties for commercial purposes; integrating generated setups into another SaaS tool or service for commercial use without prior written agreement.
5.3. Any professional or commercial use requires a specific written agreement with the publisher.
Article 6 – Prohibited behaviours and misuse
6.1. Users agree to use the service fairly and in compliance with these Terms of Use and applicable laws.
6.2. The following behaviours are forbidden:
API abuse, including massive or automated requests without authorisation; systematic scraping of setups, community presets or the interface; using bots or automated scripts to bypass usage limits; any attempt to circumvent the credit system (exploits, request tampering, response modification, etc.); reselling or mass redistribution of setups outside the licence granted in Article 9; submitting illegal, hateful, offensive, pornographic, violent content or content infringing third‑party rights.
6.3. The publisher reserves the right to take any appropriate measure (limitation, suspension, account termination) in case of breach.
Article 7 – BYOK (Bring Your Own Key) operation
7.1. BYOK allows users to provide their own API key (Google Gemini, OpenAI, Anthropic, etc.) to generate setups without using GT7 EngiRace credits.
7.2. The API key is stored encrypted on the server side (AES‑256‑GCM) and is never used for purposes other than generating setups for the user.
7.3. Users are solely responsible for:
creating, managing and securing their API key; complying with the provider’s terms of service (Google, OpenAI, Anthropic, etc.); costs charged by the provider for use of the key.
7.4. In case of key leakage, fraud or quota overrun, the GT7 EngiRace publisher cannot be held liable; users must revoke their key with the provider.
Article 8 – Availability, maintenance and changes
8.1. The service is provided “as is”, without any guarantee of continuous availability.
8.2. The publisher endeavours to keep the service operational, but may:
temporarily suspend access for maintenance, updates or security reasons; change certain features, interface elements or tuning rules.
8.3. The publisher does not guarantee:
absence of bugs, interruptions or defects; in‑game performance or race results based on generated setups.
8.4. In case of major changes, users may be informed via on‑site notices or email.
Article 9 – Intellectual property and licence on setups
9.1. The GT7 EngiRace service, its interface, code, database, logos and content are protected by intellectual property rights. Any unauthorised reproduction or exploitation is prohibited.
9.2. Generated setups (whether from rules‑only mode, AI via credits or AI via BYOK) are technical recommendations produced by the service.
9.3. The publisher grants users a personal, non‑exclusive, non‑transferable licence to:
use the setups in‑game (Gran Turismo 7) for personal purposes; adapt the setups for their own race needs.
9.4. This licence does not authorise:
direct resale or commercialisation of setups; mass publication of setups in a competing service; professional use of setups without a specific agreement.
Article 10 – User account, suspension and termination
10.1. Users are responsible for all activity carried out through their Clerk account and must immediately inform the publisher of any suspected unauthorised access.
10.2. In the event of a breach of these Terms of Use, especially fraud, credit circumvention, API abuse or illegal content, the publisher may:
restrict access to certain features; suspend the account temporarily; terminate the account without notice in case of serious breach.
10.3. Users may request account deletion in accordance with the Privacy Policy. Account deletion may result in loss of unused credits and setup history.
Article 11 – Liability
11.1. Generated setups are suggestions. Users remain solely responsible for:
applying them in game; their performance and results; compliance with race rules, online platform rules and any competition regulations.
11.2. The publisher cannot be held liable for any direct or indirect damage (loss of opportunity, data loss, loss of profit) arising from:
use or inability to use the service; bugs, errors or downtime.
Article 12 – Reference to Terms and Conditions of Sale
12.1. Any paid operation (credit purchases, premium services, AI options) is governed by the site’s Terms and Conditions of Sale (CGV).
12.2. The CGV specify in particular:
prices, payment methods, withdrawal right (if applicable); statutory warranties and specific liability limitations for purchases.
Article 13 – Mediation, governing law and jurisdiction
13.1. These Terms of Use are governed by French law.
13.2. In case of dispute, users are invited to contact the publisher at valentin@dislo.fr to seek an amicable solution.
13.3. If the dispute persists, consumer users may refer the matter to a consumer mediation service such as CM2C (or any appointed mediator), under applicable consumer law.
13.4. Failing amicable resolution or mediation, courts in Montpellier (France) will have jurisdiction, without prejudice to mandatory consumer protection rules.
Article 14 – Changes to the Terms of Use
14.1. The publisher may change these Terms of Use at any time to:
reflect technical or organisational changes; comply with legal or regulatory developments; adapt service usage rules.
