Article 3 – Description of the GT7 EngiRace service
3.1. Nature of the service
GT7 EngiRace is a SaaS (Software as a Service) available online, offering:
- rules-only setup generation (settings based on predefined rules without AI);
- AI-powered personalised setup generation based on the car, track, and user goals.
3.2. Access without an account
Without creating an account, users may access rules-only setup generation free of charge, within the technical limits defined by the Publisher.
3.3. User account and AI credits
User accounts are created via the Clerk authentication provider. Upon registration, users receive 5 complimentary AI credits. AI credits are consumable digital goods: 1 AI credit = 1 successful AI generation of a personalised setup (car / track / goal).
No credit is deducted in the event of:
- technical failure of the AI generation;
- reuse of an exact community preset identical to an existing configuration.
Rules-only setups remain free at all times, including for registered users.
3.4. BYOK – Bring Your Own Key
Users may connect their own Google Gemini API key ("BYOK") to benefit from unlimited free AI generations via their own key, at their sole responsibility. In this case, the Publisher does not charge AI credits; the user remains responsible for use of their API key and any associated costs or limits imposed by Google or any key provider.
3.5. No official affiliation
GT7 EngiRace is not affiliated with Sony Interactive Entertainment, Polyphony Digital, or the Gran Turismo franchise. Any reference to Gran Turismo 7 is for descriptive and compatibility purposes only.
Article 4 – Service access conditions
4.1. Capacity and consumer status
The service is intended for adult consumers within the meaning of the French Consumer Code. Any person using the Site declares that they have full legal capacity to contract and that they use the service for personal, non-professional purposes.
4.2. User account
Creating an account requires providing accurate and up-to-date information, and accepting these Terms and, where applicable, the Privacy Policy. Users are responsible for keeping their credentials confidential and for all activity on their account.
4.3. Service availability
The Seller uses reasonable efforts to ensure service availability. Temporary interruptions may occur (maintenance, updates, technical incidents). In the event of prolonged unavailability, the Publisher may communicate via the Site or by email.
Article 5 – Pricing
5.1. AI credit pricing (one-time payment, incl. tax)
AI credit pack prices are shown in euros including all taxes (EUR incl. tax) as follows:
| Pack | Credits | Price (incl. tax) |
|---|---|---|
| Sprint | 5 | €2.99 |
| Race | 40 | €7.99 |
| Season | 120 | €19.99 |
Rules-only setups remain free and require no AI credits.
5.2. VAT
By default, the Seller operates under the "VAT not applicable, Article 293 B of the French General Tax Code" regime. However, for B2C sales in France of digital content/services, standard VAT (currently 20%) may apply. Where applicable, VAT is collected and managed via Stripe Tax or a similar solution, in compliance with applicable tax law. Prices shown on the Site indicate whether tax is included, and users are informed before final order confirmation.
5.3. Price changes
The Seller reserves the right to change prices at any time. Price changes will not affect orders already paid and confirmed. The prices in force are those displayed on the Site at the time of order.
Article 6 – Order and payment
6.1. Order process
AI credits are ordered online via the Site, following these steps:
- selection of an AI credit pack;
- display of the total price incl. tax and essential contract terms;
- validation of billing information;
- order confirmation and acceptance of these Terms;
- secure payment via Stripe.
Before final confirmation, users may review their order details and correct any errors.
6.2. Payment method
Payment is made by bank card via Stripe. The Publisher does not store full card details; these are processed by Stripe as the payment provider.
6.3. Payment security
Stripe implements industry-standard security measures (encryption, PCI-DSS compliance, etc.). Users agree to use a personal, valid payment method. If payment is declined, the order will not be confirmed.
6.4. Order confirmation
The contract is concluded and the order is binding upon payment validation by Stripe, then upon receipt of payment confirmation by the Seller's system (Stripe webhook). A confirmation email may be sent to the address provided when creating the account or during payment.
Article 7 – Delivery and performance
7.1. Immediate performance
AI credits constitute digital content supplied without physical media within the meaning of the French Consumer Code. Performance is immediate upon payment confirmation by Stripe: AI credits are added to the user account and may be used without delay, subject to proper technical operation of the service.
7.2. Digital delivery incident
If AI credits are not credited despite payment confirmation, users should contact support at valentin@dislo.fr with the transaction reference. The Publisher will investigate and may re-credit missing credits or issue a refund where appropriate.
Article 8 – Right of withdrawal and waiver
8.1. Legal principle for digital content
Under the French Consumer Code, the right of withdrawal cannot be exercised for contracts supplying digital content without physical media where performance has begun before the end of the withdrawal period, when the consumer has expressly consented to performance beginning before the 14-day period expires and has acknowledged that they lose their right of withdrawal.
8.2. Consent and waiver at checkout
When ordering AI credits, users check (or confirm) a box stating that AI credits will be supplied immediately after payment and expressly acknowledge that this immediate performance results in loss of their right of withdrawal under applicable regulations. By confirming the order, users consent to immediate performance and waive their statutory right of withdrawal for AI credits.
8.3. Commercial refund policy (beyond legal requirements)
Without prejudice to the waiver of the right of withdrawal, the Seller offers a more favourable commercial refund policy on the following terms:
- users may request a refund of unused AI credits within 14 days of purchase;
- after this period, no refund request will be accepted;
- credits already consumed (having enabled at least one successful AI generation) are non-refundable.
Refund requests must be submitted in writing to valentin@dislo.fr, stating the purchase date, account identifier, and number of unused credits.
Article 9 – Legal and commercial warranties
9.1. Legal warranties
Under the French Consumer Code, users benefit from legal warranties applicable to digital content and services, including in cases of non-conformity or failure to provide the paid service. However, given the nature of the service (setup recommendations), conformity is assessed primarily with regard to provision of AI credits and operation of the generation service (access, technical execution), not in-game results (race performance).
9.2. Commercial warranties
Unless otherwise stated on the Site, no race performance, ranking, or result is guaranteed. The Seller may occasionally offer promotional deals or specific commercial warranties, which will be clearly indicated on the Site.
Article 10 – Liability
10.1. No performance guarantee
Setups generated by rules or AI are recommendations and should be treated as suggestions. Users remain solely responsible for applying them in Gran Turismo 7, as well as for driving settings, hardware configuration, and driving style. No race performance is guaranteed.
10.2. Service provided "as is"
The GT7 EngiRace service is provided "as is", without guarantee of continuity or complete absence of bugs. The Seller undertakes to fix major malfunctions within reasonable timeframes but cannot guarantee uninterrupted operation.
10.3. Limitation of liability
To the extent permitted by applicable law, the Seller's liability is limited to direct, foreseeable material damage resulting from compliant use of the service, and in any event to an amount not exceeding the price paid by the user for AI credits over the preceding 12 months.
The Seller shall not be liable for data loss not attributable to serious fault on its part, indirect damage (loss of opportunity, profits, etc.), or consequences of use of the user's personal API key (BYOK).
10.4. Community content and hosting
The Site may offer community presets or contributions. Where the Publisher hosts such content, it acts in accordance with French law on publisher and host liability; it may remove manifestly unlawful content reported to it and cooperate with competent authorities where necessary.
Article 11 – Personal data and cookies
11.1. Data controller
The controller of personal data collected via the Site is DUPIN Valentin, sole proprietor, 271 bis chemin des craoux, 84310 Morières-lès-Avignon, France.
11.2. Main subprocessors
The Seller uses the following providers in particular: Clerk (authentication), Stripe (payments), Turso (database hosting), Google Gemini (platform AI).
11.3. Processing purposes
Data is processed mainly for account management, service provision, payment processing, Site security, customer relations, and continuous service improvement.
11.4. Legal basis and data subject rights
Under the GDPR, users have the right of access, rectification, erasure, restriction, objection, and portability, as well as the right to lodge a complaint with the CNIL (French data protection authority). Detailed procedures are set out in the Privacy Policy available on the Site.
11.5. Cookies and trackers
The Site may use cookies and other trackers for technical purposes, audience measurement, or user experience improvement. Cookie deployment and management are described in the dedicated policy.
Article 12 – Intellectual property
12.1. Ownership of the Site and service
All elements of the Site and GT7 EngiRace service (text, graphics, logos, interfaces, databases, algorithms, etc.) are protected by copyright and, where applicable, trademark and database rights. Any unauthorised reproduction, representation, modification, adaptation, distribution, or exploitation is prohibited.
12.2. Generated setups
Generated setups (rules-only or AI) are provided to users for personal, non-commercial use within Gran Turismo 7. Any large-scale, automated, or commercial reuse without prior authorisation from the Seller is prohibited.
12.3. No affiliation
GT7 EngiRace is not affiliated with Sony Interactive Entertainment, Polyphony Digital, or Gran Turismo. Third-party trademarks and logos remain the property of their respective owners.
Article 13 – Termination and account deletion
13.1. Termination by the user
Users may request deletion of their account at any time via the procedures on the Site or by contacting support at valentin@dislo.fr. Account deletion does not automatically entitle users to a refund of unused AI credits, except under the commercial refund policy (Article 8.3).
13.2. Termination by the Seller
The Seller may suspend or terminate a user account without notice in cases including serious breach of these Terms, attempted fraud, or abusive or improper use of the service (including BYOK keys or APIs). In case of termination for fault, unused credits may be cancelled without compensation.
13.3. Consequences of termination
Termination or account deletion removes access to the service. Certain data may be retained for the period necessary to comply with legal obligations (billing, accounting, evidence).
Article 14 – Force majeure
The Seller shall not be liable for any delay or failure to perform resulting from force majeure within the meaning of French law and jurisprudence (e.g. widespread network failure, large-scale cyberattacks, natural disasters, pandemic, etc.). In case of force majeure, contract performance is suspended for the duration of the event. If force majeure continues beyond 60 days, either party may terminate the contract without compensation.
Article 15 – Changes to the Terms
The Seller reserves the right to amend these Terms at any time, particularly to reflect legislative, regulatory, technical, or commercial changes. The updated Terms apply to orders placed from the date they are published on the Site. Users are invited to review the latest version of the Terms available on the Site regularly.
Article 16 – Severability
If any provision of these Terms is held to be null, invalid, or unenforceable, such invalidity shall not affect the remaining provisions, which shall remain in force. The parties agree to replace the invalid provision with a valid provision reflecting the spirit of the original as closely as possible.
Article 17 – Governing law and dispute resolution
17.1. Governing law
These Terms and contracts concluded via the Site are governed by French law.
17.2. Consumer mediation
In the event of a dispute relating to these Terms, users are invited to send a written complaint to valentin@dislo.fr. If the dispute persists, users may use a consumer mediator free of charge: CM2C (Centre de Médiation de la Consommation de Conciliateurs de Justice), www.cm2c.net.
17.3. Competent courts
Failing amicable resolution or mediation, the dispute shall be submitted to the courts with jurisdiction under the territorial rules applicable to consumers.
Article 18 – Effective date
These Terms take effect on 18 July 2026 and supersede all prior versions.
